NORMS OF LAW AS SOURCES OF ORGANIZATION OF PUBLIC CONTROL OVER COMPLIANCE WITH TRANSPORT LEGISLATION

Abstract

The article examines the norms of law as a source of organizing public control over compliance with transport legislation. It is substantiated that modern legal regulation of the transport sector in Ukraine is formed in the context of a combination of national and international regulatory frameworks, and the effectiveness of control procedures largely depends on the level of implementation of international legal standards in domestic legislation. It is established that international treaties, acts of the European Union, as well as strategic documents that determine the directions of modernization of the transport sector, requirements for transportation safety, environmental standards, protection of passenger rights and professional competence of carriers are of particular importance in this area. It is found that in the context of Ukraine’s European integration course, international legal norms perform not only a guiding but also a system-forming function, since they influence the content of national transport legislation, determine the principles of organizing control activities and contribute to the unification of administrative and legal mechanisms for supervision in the transport sector. The main directions of implementation of EU law acts in the field of road, rail, sea, inland waterway, air transport, as well as in the field of transportation of dangerous goods are analyzed. It is proved that the current legislation of Ukraine already takes into account a significant part of the requirements of European law, but requires further improvement in order to fully implement the relevant directives and regulations. It is emphasized that, despite the importance of international legal regulation, the decisive role in the practical provision of transport control belongs to national legislation, which specifies international standards by establishing certification procedures, technical control, requirements for transportation participants, legal liability measures and organizational principles of the activities of authorized bodies. It is concluded that the optimal direction for improving the legal provision of public control in transport is not the adoption of a separate codified act, but the systematic updating of the current transport legislation, its harmonization with international standards.
