FEATURES OF PROVIDING BY THE INVESTIGATING JUDGE THE RIGHT OF VICTIMS TO AN EFFECTIVE MEANS OF LEGAL PROTECTION DURING THE PRE-TRIAL INVESTIGATION

The article deals with study of the possibilities of realization by the victim of the right to an effective means of legal protection during the pre-trial investigation and the effectiveness of the exercise of the powers of the investigating judge during the consideration of complaints about the decisions, actions or inaction of the pre-trial investigation bodies or the prosecutor to realize the victim’s procedural rights and perform procedural duties. Research of scientific literature, personal experience of the author, analysis of law enforcement practice and conducting a research survey among practicing lawyers in the field of criminal procedural law made it possible to assert that today there are problems of regulatory support and practice of exercising the powers of an investigating judge when considering complaints about decisions, actions or inaction of pretrial investigation bodies and the prosecutor’s office that require scientific study. It is concluded that it is necessary to amend the criminal procedural legislation and allow the investigating judge to make decisions that oblige representatives of pre-trial investigation bodies and the prosecutor to take specific procedural actions to ensure the rights of victims and increase the effectiveness of pre-trial investigation.
