WEAPONS, AMMUNITION AND EXPLOSIVE DEVICES AS MANDATORY FEATURES OF CRIMINAL OFFENSES

The composition of criminal offenses, the obligatory sign of which is firearms, ammunition and explosive devices, is distinguished. The signs of the influence of these objects on the degree of social danger of such acts are determined.It is noted that depending on the generic object, criminal offenses, the obligatory sign of which is weapons, ammunition and explosive devices, are divided into ten types. The specified objects in the composition of these criminal offenses have different criminal-legal significance (the subject or feature of the subject of the criminal offense and the tools or means of the criminal offense). At the same time, the Criminal Code of Ukraine contains a significant number of criminal offenses in which weapons, ammunition and explosive devices are not a mandatory feature, but their use significantly affects the degree of public danger of these acts.It is proposed to provide for the use of the specified objects as aggravating circumstances of serious and especially serious intentional crimes against life, health and property of a person.
