THE SYSTEM OF ACTORS OF PUBLIC CONTROL OVER COMPLIANCE WITH THE LEGISLATION ON TRANSPORT

Abstract

The scientific article deals with issue of defining the system of actors of public control over compliance with legislation on transport. The work determined that the system of subjects of public control on transport is a complex interaction of various bodies and institutions, called to ensure compliance with legislation in the field of transport and traffic safety. The content of the concept of «subjects of public control over compliance with legislation on transport» is defined, it is emphasized that such subjects are subjects of legal relations. It has been clarified how the concepts of «subjects of state control», «subjects of public control», «subjects of public control» are related to each other. Proposed functions of subjects of public control over compliance with legislation in transport: rule-making; licensing and certification function; function of direct application of control measures; service function; information function. The authors’ position on the priority of spreading the decentralization of transport management and coordination of the activities of public administration entities in the field of transport during the implementation of the state transport policy is supported.Emphasis is placed on the fact that the coordination of the activities of the subjects of public control in transport is a necessary condition for the effective provision of safety in transport, compliance with legislation and high quality of transport services. Typical problems of coordination of subjects of public control over compliance with legislation on transport were noted: duplication of functions; lack of a unified approach; bureaucratic barriers; insufficient funding. It has been established that the coordination of the activities of subjects of public control in transport is a continuous process. Proposed measures to improve the coordination of subjects of public control over compliance with legislation on transport: creation of a unified state information system; expanding the use of electronic services; active involvement of the public in control; improving the qualifications of employees of controlling entities.
