CERTAIN ISSUES OF COOPERATION BETWEEN UKRAINE AND THE INTERNATIONAL CRIMINAL COURT

The study is based on the consideration of conceptual issues related to the expediency of Ukraine’s ratification of the Rome Statute of the International Criminal Court (hereinafter – ICC), the extension of the ICC’s jurisdiction and the possibility of bringing the aggressor country to justice for the crime of genocide, crimes against humanity, war crimes and the crime of aggression, as well as legal aspects of Ukraine’s cooperation with the ICC.It is determined that the ratification of the Rome Statute has the following consequences: first, joining the ICC does not carry any new risks for Ukraine; second, ratification will not only oblige Ukraine to cooperate with the ICC, but will also give Ukraine access to what it does not currently have – additional substantive and procedural rights; third, ratification is important as a mechanism for bringing putin, the highest military command and other officials of the aggressor state to international responsibility for the most serious crimes committed in Ukraine.Regardless of whether the aggressor has ratified the Rome Statute, this does not protect them from prosecution if there is sufficient evidence that a criminal order was issued by one of them. At the same time, it has been proven that the International Criminal Court is not a universal mechanism for bringing the aggressor country to justice for international crimes committed in Ukraine. In this regard, our state should work hard to establish a special international tribunal, similar to the Nuremberg, Tokyo, Yugoslav and Rwanda International Criminal Tribunals.
