CRIMINAL LIABILITY FOR ECOCIDE: LEGAL ANALYSIS AND PROSPECTS FOR IMPROVING LEGISLATION

The article analyzes the issue of criminal liability for ecocide in the context of current Ukrainian legislation. The elements of the criminal offense under Article 441 of the Criminal Code of Ukraine, including the object, subject, objective and subjective sides are considered. Particular attention is paid to the concept of «environmental disaster», which does not have a clear legislative definition, which complicates law enforcement. The author emphasizes the need to clarify the criteria for mass destruction of flora and fauna, poisoning of the atmosphere, land and water bodies.The author analyzes the gaps in the definition of the subjective side of ecocide, in particular intent, as well as the specifics of the subject composition, including the responsibility of officials, military and transnational corporations. The author highlights the relevance of international experience and recommendations for harmonizing Ukrainian legislation with international standards. Proposals are made to improve Article 441 of the Criminal Code of Ukraine, in particular, by adding qualifying features and the term «intentional» to the wording of the crime. The article emphasizes the need to adapt criminal law to modern environmental challenges, including the impact of armed conflicts on the environment. As a result, the author formulates recommendations aimed at enhancing the effectiveness of protection of Ukraine’s ecosystem and ensuring environmental safety.
