COLLECTION OF ALIMONY FOR MINORS UNDER MARITAL LAW: JUDICIAL PRACTICE

Abstract

The judicial practice on the collection of alimony for minor children in the context of martial law was studied. The normative and legal acts regulating relations in the specified sphere, court decisions related to the collection of alimony for minor children in martial law conditions were analyzed.In particular, the following issues were considered: changes in the amount of alimony, the procedure for their payment, ensuring the execution of court decisions, as well as the impact of martial law on the child's rights to proper maintenance.Alimony for the child is calculated according to the court's decision from the date of filing the lawsuit, and in the case of filing an application for the issuance of a court order - from the date of filing the application. When a person receives a court decision to collect child support for a minor child and this decision is in favor of the child, there are several options for its implementation (voluntary and forced execution of the court decision).Currently, many people are mobilized to defend our land from the occupiers. In this regard, the question of whether it is possible to collect child support for a minor child from a payer who is in the Armed Forces of Ukraine has become very widespread. In this regard, the legislation clearly states that there are no restrictions on the collection of child support from military personnel. Therefore, military personnel, as a rule, pay child support on a general basis and from all types of financial support.The conducted research allows to identify trends, problems and features that arise in the specified area of legal relations under martial law.
