THE INSTITUTION OF CIVIL (REGISTERED) PARTNERSHIPS AS A COMPONENT OF PREVENTING DISCRIMINATION AGAINST LGBT PERSONS IN UKRAINE

The article attempts to provide a scientific justification for the importance of regulatory consolidation of the institution of civil (registered) partnerships as a component of preventing discrimination against LGBT persons in Ukraine. The importance of scientific research on problematic aspects of protecting human rights and freedoms to overcome gender-based violence, discrimination and segregation in Ukrainian society is emphasized.Attention is drawn to the Judgment of the European Court of Human Rights in the case of application No. 75135/14 «Maimulakhin and Markiv v. Ukraine» and the draft Law of Ukraine on the Institute of Registered Partnerships No. 9103 of 13.03.2023. It is emphasized that the institution of civil (registered) partnerships is one of the legal forms of regulating relations between persons who have a common life (live together) but are not married.The relevant legal form of partnership applies not only to LGBT persons, but is also provided for homosexual and heterosexual couples in cases where, due to certain circumstances, the partners are unable or unwilling to enter into a conventional marriage. The author concludes that the introduction of the civil (registered) partnership institution should help ensure the right to create a family for every citizen of Ukraine, and also provide confidence to persons who are unable to enter into a regular marriage for one reason or another. This is not the only, but so far, the best alternative to ensure that sexual orientation and gender identity are not grounds for discrimination in Ukraine.Civil (registered) partnerships should contribute to the establishment of Ukraine as a democratic state with modern European values. They will officially recognize a form of relationship between two people, regardless of their gender, and provide partners with certain rights and obligations similar to those of a regular marriage. This form of formalized partnership will guarantee legal protection for partners in such important issues as inheritance, medical interventions, social benefits and protection, support, property, care, protection from domestic and other gender-based violence, etc.
