STATE OF SCIENTIFIC SUPPORT FOR THE INVESTIGATION OF CRIMES RELATED TO THE ESTABLISHMENT OR EXPANSION OF CRIMINAL INFLUENCE

Abstract

The article, based on the analysis of professional legal literature, examines the state of scientific development of the problems of detecting and investigating crimes related to the establishment or expansion of criminal influence. Based on the results of using certain methods of scientific knowledge, in particular analysis, synthesis and comparison, the article identifies the main approaches to the outlined issues, including the existing criteria for systematizing such research when revealing issues while covering the state of scientific development in related fields of knowledge, in particular: criminal legal assessment; regulatory and legal definition; classification by scientific areas, specific investigation methodology, operational and investigative combating organized criminal activity, etc. As a result, in the context of the subject of the study, it is proposed to systematize the existing scientific research within the sciences of the criminal legal cycle, namely: criminal law, criminal procedure and forensics, theory of operational and investigative activities. Accordingly, the article highlights the work of specialists in the field of criminal legal support and assessment, forensic support of investigation, operational-search combating the activities of organized criminal associations. The study of scientific research according to this classification allowed the author to conclude that the issues of detecting and investigating crimes related to the establishment or expansion of criminal influence have been studied only fragmentarily. The largest number of professional scientific developments was noted on the issues of criminal legal support, which is due to the amendments to the Criminal Code of Ukraine in 2020. Also, the scientific works of domestic researchers on the issues of operational-search combating the activities of criminal associations by types of crimes, which are of great importance in the context of further study of the issues of interaction between investigators and operational units on the subject of research, were identified and investigated. A decisive place is given to scientific works on the issues of forensic support for the investigation of criminal offenses committed by organized groups and criminal organizations. The above allowed to identify poorly researched issues and determine priority areas for further scientific research on the issues of investigating crimes related to the establishment or expansion of criminal influence.
