QUALIFYING FEATURES OF THE IMPORT, MANUFACTURE, SALE AND DISTRIBUTION OF PORNOGRAPHIC OBJECTS

Abstract

The article addresses the important issue of the illegal circulation of pornographic materials in Ukraine, particularly in the context of the criminal offense outlined in Article 301 of the Criminal Code of Ukraine. It analyzes the statistics related to crimes associated with the production, distribution, and dissemination of pornography, as well as the importance of combating this phenomenon. It is noted that the problem has several aspects: firstly, the illegal circulation of pornography harms the morality and mental health of citizens, especially minors, who are particularly vulnerable to the negative consequences of such content. Secondly, technological advancement, particularly the widespread use of the Internet, has significantly complicated efforts to combat the distribution of pornography through the web. The article emphasizes that with the development of technology and the increasing number of digital resources available for the distribution of pornography, there is an urgent need to strengthen control over online content and improve the legal and regulatory framework to more effectively combat these crimes. The article further discusses the growing challenges in enforcing laws related to the illegal distribution of pornography due to the rapid evolution of digital platforms and technologies. It highlights the increasing difficulty for law enforcement agencies to track and combat such crimes in the digital age. The proliferation of online forums, social media platforms, and anonymous file-sharing systems has made it easier for individuals to distribute and access illegal content, often with minimal risk of detection. In addition, the article calls for the implementation of educational campaigns to raise awareness of the risks associated with online pornography and its impact on mental health, especially for young people. It suggests that the authorities should increase collaboration with international law enforcement bodies to combat the global nature of the issue, given that pornography often transcends national borders.
