CONCEPTUAL APPROACHES TO UNDERSTANDING THE ADMINISTRATIVE PROCEDURE IN THE MODERN ADMINISTRATIVE LAW OF UKRAINE

Abstract

The article deals with study of modern conceptual approaches to understanding the administrative procedure. Attention is drawn to the fact that the issues of understanding the content of administrative procedures in the administrative law of Ukraine, taking into account the modern processes of state formation and legal understanding, remain beyond the scope of modern research. It is justified that the analysis of conceptual approaches to understanding the administrative process and administrative procedure in Ukrainian law demonstrates the complexity and multifaceted nature of this phenomenon, which requires further research and improvement of legislation in this area. The article states that administrative procedures are one of the key legal categories that play an important role in ensuring the effective functioning of the state apparatus and protecting the rights of citizens. It is emphasized that in the modern world, where public administration is constantly becoming more complicated, the issue of implementing clear and transparent administrative procedures becomes especially urgent. It is proposed that the administrative procedure should be understood as the procedure of actions of public authorities and other authorized subjects determined by law, aimed at the consideration, resolution and enforcement of cases, which includes mandatory stages and ensures transparency, accessibility and compliance with the rights and legitimate interests of all participants in the process. It is concluded that the concepts of «administrative process» and «administrative procedure» are often used in administrative law, but their relationship may vary depending on conceptual approaches to the processes of law-making and state-building. It is proven that the administrative procedure is a specific part of the administrative process, which determines the details and the procedure for performing specific administrative actions.
