Abstract

The article is devoted to a topical issue – the prospects for further development of public service in Ukraine. It is emphasized that the term “public servant” is a generalized concept, so in everyday practice, the phrases “civil servant” and “employee” are mostly used, or the type of profession within which a person holds the relevant position of a public servant is called: minister, prosecutor, police officer, military officer, etc. The analysis of current legislation and accumulated practice in organizing service activities shows that today there is a stable and generally studied but ineffective (in terms of its performance) legal institution of civil service and an organically related, but not yet formed, legal institution of municipal service, which are conditionally covered by the concept of “public service”. Experience shows that transformation processes in civil (public) service remain relevant, hence it will be essential to resolve the issue of the reform’s format. The first (the usual one, as it has been until now) is realized through separate legal regulation of sectoral social relations (state and self-government service). The second (innovative) – through legal support for the full and timely satisfaction of urgent social needs in the field of a fundamentally new integrated institution of public service, which combines two types of service activities – state and municipal service. When choosing the more promising second option, several important factors should be taken into account, namely, the existence of one common goal for both civil servants and self-government officials – serving the Ukrainian people (citizens of Ukraine); unified and general professional and ethical requirements for conduct rules for civil servants and local government officials, approved by the relevant order of the National Agency of Ukraine on Civil Service; 66 percent coincidence between the principles of state and municipal service, as noted earlier in the analysis of the specific legislation.
