Abstract

The human right to peaceful assembly needs urgent legislative regulation. International documents establish only the general principle of the right to peaceful assembly, so that this right as a whole is confirmed by the Constitution and clarified by national laws and statutes, which describe in more detail specific procedures for guaranteeing the right to freedom of assembly. First of all, this regulation is necessary to give executive authorities and local self-government bodies time to take appropriate measures to ensure the proper realization of this right. At the same time, establishing a certain procedure for holding peaceful assemblies and other mass events will create an opportunity to officially determine the circle of responsible persons in the event that officials of executive power bodies and local self-government bodies create obstacles to the realization of the human right to peaceful assembly. It should be remembered that the right to peaceful assembly is an important part of the preservation, development and critical evaluation of cultural and social norms and values. This right is important for the preservation and expression of minority identity and the responsibility of state authorities. Protecting the right to peaceful assembly is crucial to creating a tolerant and pluralistic society in which different communities can coexist peacefully. This work, using practical experience in law enforcement, analyzed the existing regulatory legal framework of Ukraine in the sphere of the realization of the human right to peaceful assembly, restrictions on the right to peaceful assembly, ensuring public (public) order and security during peaceful assembly, responding to offenses and incurring administrative or criminal liability in the event of their commission by organizers or participants of peaceful assemblies, as well as by officials of executive power bodies and local self-government bodies. In connection with the absence of a procedure for holding peaceful assemblies, as well as other mass events, namely the absence of clearly defined deadlines for the organizer of the event to provide notice to executive authorities or local self-government bodies, it was found impossible for these authorities (in some cases) to apply to the court for the purpose of restriction of the right to peaceful assembly.
